We want to keep you informed about the latest tariff developments that may impact your imports.
Effective Tuesday, February 4, 2025, at 12:01 a.m. EST, new tariffs will be imposed under the International Emergency Economic Powers Act (IEEPA) as follows:
Key Tariff Updates
- 25% tariffs on imports from Canada and Mexico
- 10% tariffs specifically on “energy imports” from Canada, as defined in Section 8 of Executive Order 14156 (Jan. 20, 2025). This includes:
- Crude oil, natural gas, lease condensates, natural gas liquids, refined petroleum products
- Uranium, coal, biofuels, geothermal heat, kinetic movement of flowing water
- Critical minerals as defined by 30 U.S.C. 1606 (a)(3)
- 10% tariffs on imports from China
- Tariffs are determined by the country of origin, not the country from which the goods were shipped.
- Exemptions: Goods that were loaded onto a vessel at the port of loading or were in transit on the final mode of transport before 12:01 a.m. EST on February 1, 2025, are not impacted by these tariffs.
Additional Considerations
- De minimis entry and duty drawback are NOT available for goods originating from Canada, China, or Mexico under this tariff action.
- Because the actions were taken under the IEEPA, tariffs apply at the ad valorem rate and are owed in addition to normal duties and any applicable Section 201, 232, and 301 duties, antidumping, or countervailing tariffs.
- These new tariffs also apply to USMCA-qualifying merchandise and products eligible for specific product exclusions.
- No product exclusion has been communicated yet.
- Applied tariff rates may be increased and the scope of the order expanded if impacted countries issue any retaliation measures.
.
Impact on Your Shipments
- Ocean Cargo: If your shipment departed China before February 1, 2025, no tariff increase applies.
- Air Cargo: If your shipment departed on or after February 1, 2025, the new tariffs will apply.
